Corporate criminal law
In contrast to other countries there is still no „real“ corporate criminal law in Germany. Its implemen-tation is over and over discussed in legal policy. But under § 30 OWiG a company can be judged to pay a fine up to an amount of 10 Mio. Euro, if particular employees committed a crime.
If a company is confronted with criminal accusations, it is essential that there is not only a lawyer for the individuals but also one for the company itself.
Beside the financial risks there is need for a corporate lawyer in order to coordinate the company’s interests, such as communication with the individuals’ lawyers or representatives of the press.
